In 2005 an illegal immigrant was charged with a hit-and-run that ultimately led to the death of an 83-year old WWII veteran. Aubrey Sosebee was out getting his mail when he was struck by a car driven by Celso Campo-Duartes. Sosebee later died of his injuries. Since then, Celso Campo-Duartes has been arrested three additional times in Georgia.

Family members of the victim -- Aubrey Sosebee -- had been under the impression Campo-Duartes was no longer in the country. But Stacey Bourbonnais, the Gwinnett Sheriff’s public information officer, told Fox News that Campo-Duartes was not deported after all. Bourbonnais says the deportation of illegal immigrants is under the juridiction of the federal government's Immigration and Customs Enforcement Agency.

The process, however, has changed since Campo-Duartes first two arrests. In November of 2009, Gwinnett County was approved for a program called 287 (g). It's a training program for state and local agencies to identify illegal immigrants who have been charged with a crime, put that person on a hold, and hand them over to ICE after that suspect has been released.

""They have to be charged on the street for a crime, "" Bourbonnais said. ""They are not asked their status on the street, people aren’t out looking for you just because your foreign born.""

Authorities say it is already preventing the repeat offenders.

""From Nov. 16, 2009, when 287(g) started until today - we have booked 3,174 fewer foreign born inmates than the same time period the previous year,"" she said.

So far, more than 1,000 officers have been trained and certified and ICE has 71 agreements in 26 states. Local agencies must apply to be part of the program and fund the positions locally but ICE offers a four-week training program which includes course work in immigration law as well as comprehensive instruction on ICE's databases.
